These Terms & Conditions ("Terms") govern your access to and use of MisiCerdas, an online educational platform operated by Nexday Enterprise (202103178158(003282662-U)), a business registered in Malaysia ("we", "us", "our").
By registering for an account or using the service, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. The Service
MisiCerdas is a subscription-based learning platform that provides daily practice missions in Mathematics and English for primary school children (ages 7–12). The service is accessed via a web application and is designed to be used under parental supervision.
2. Eligibility & Accounts
- A parent or legal guardian must create and own the account. Children do not create their own accounts.
- You must be at least 18 years old to register.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must provide accurate and current information during registration and keep it up to date.
3. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any Malaysian law.
- Attempt to reverse-engineer, copy, or redistribute any content or code on the platform.
- Share your account credentials with persons outside your immediate family.
- Use automated tools (bots, scrapers) to access the service.
4. Subscriptions & Billing
Access to the full features of MisiCerdas requires an active paid subscription. Subscription plans, pricing, and included features are described on our Pricing page.
- Payment is processed securely via Curlec. By subscribing, you authorise us to charge your chosen payment method for the applicable subscription fee.
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- We reserve the right to change subscription prices with at least 30 days' prior notice. Continued use after the price change takes effect constitutes acceptance of the new price.
5. Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until that date. Our full refund policy is set out in our Refund & Cancellation Policy.
6. Intellectual Property
All content on the platform — including questions, explanations, graphics, and software — is owned by or licensed to us. You may not reproduce, distribute, or create derivative works without our written consent. Nothing in these Terms grants you any ownership rights in the platform or its content.
7. Children's Privacy
We collect limited data about child profiles strictly for the purpose of delivering the educational service. Parents control all child data. Please review our Privacy Policy for full details. We comply with Malaysia's Personal Data Protection Act 2010 (PDPA).
8. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, our aggregate liability to you for any claim arising from your use of the service shall not exceed the total fees paid by you in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential losses.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
